Isolator Equipment Warranty Charles River Laboratories, Inc. warrants its gnotobiotic isolator products and component parts against defects in materials and workmanship, under normal use and service, for a period of one (1) year after date of shipment. Charles River's obligation under this warranty being limited to replacement or repairing F.O.B. our Wilmington, Massachusetts facility any part of its own products which within ninety (90) days from date of delivery and not more then one (1) year after date of shipment is proven to be defective, provided the purchaser has given Charles River prompt written notice upon the discovery of such defect. Charles River shall have sole authority to determine type and means of repair or replacement in the event of such a claim. Charles River shall have the option of requiring the return of the defective material, transportation pre-paid, to establish the claim. Charles River shall in no event be held liable for repairs or alterations unless made with its written consent or approval. Charles River shall not be held responsible for repairs made by others. Charles River shall not be liable for any special, indirect, or consequential damages, or for any damages arising from the use of products specified herein. THIS SHALL BE THE EXCLUSIVE WARRANTY OF CHARLES RIVER AND CHARLES RIVER DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES OR REPRESENTATIONS, EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE PRODUCTS SPECIFIED HEREIN, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Buyer agrees that this sale is completely made in the Commonwealth of Massachusetts in that the laws of the Commonwealth of Massachusetts shall apply concerning any controversy or claim regarding the products specified herein. |
